The Supreme Court considered whether a landlord can pursue eviction on alternative grounds after possession has already been taken on one ground under the Kerala Buildings (Lease and Rent Control) Act, 1965. The High Court had held that once possession was taken under the demolition ground (Section 11(4)(iv)), the alternative ground of tenant acquiring other premises (Section 11(4)(iii)) could not be pursued. The Court reversed this, holding that different grounds for eviction have distinct legal ramifications and remain viable independently. The case was remitted to the High Court for reconsideration on merits of all pleaded grounds.
