Two accused persons were convicted of kidnapping a minor girl under Sections 344 and 366 of the Indian Penal Code, aided by the principal offender. The High Court affirmed their convictions. On appeal to the Supreme Court, while the convictions were upheld, the Court modified the sentences. Considering that the appellants played a secondary role (merely providing transport), had already served three months in custody, and were the sole breadwinners for a minor child and elderly parents, the Court reduced the sentence to the period already served and ordered their immediate release, unless required in another case.
