T. Raju sought a writ to be advised from a 1992 rank list for the post of Excise Inspector under the Ezhava reserved quota. The High Court upheld his claim and directed his appointment on the next available vacancy without disturbing the seniority of 83 previously advised candidates. The State and another appellant challenged this. The Supreme Court dismissed the appeals, holding that under Rule 27 of the Kerala State and Subordinate Service Rules, 1958, seniority is determined by the effective date of advice (not appointment date). T. Raju's seniority was fixed as 01.04.1999 (the next advisable vacancy after the last prior advice), and he was to receive appropriate promotions without backdated monetary benefits.
