This appeal challenges an order by the Madras High Court discharging an accused from charges of murder and rioting. After charges were framed, he filed another application seeking modification of the charge under Section 216, which was again dismissed. The High Court's subsequent decision to discharge him was held unjustifiable. The Supreme Court restored the trial court's order, ruling that revisional jurisdiction cannot be exercised against interlocutory orders and that the accused cannot file successive applications for discharge after finality was reached. The trial was directed to proceed expeditiously.
