Kailash Chand vs State of Rajasthan

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Kailash Chand was convicted under sections 307 and 326 IPC (attempting to cause hurt) and sentenced to 4 years' imprisonment. The High Court upheld this conviction. Nearly 30 years later, Chand and the injured victims—his brother and sister-in-law—reached a written settlement resolving their family dispute amicably. The Supreme Court granted special leave and allowed their compromise application, exercising Article 142 jurisdiction. Although these are non-compoundable offences, the Court found that complete justice required acquitting Chand, given the old incident, family reconciliation, settlement, and absence of any repeat incident. Chand was ordered released immediately.
