Kamalabai vs State of M.P. & Anr

Bench: 2 — Anil R. Dave

In Brief

Kamalabai challenged land acquisition initiated under Section 4 of the Land Acquisition Act, 1894, by the State of Madhya Pradesh. The Supreme Court noted a related appeal (Civil Appeal Nos. 7261-7262/2015) concerning the same acquisition notification where the State had been represented. Finding the matter similar, the Court disposed of Kamalabai's appeal as allowed in identical terms, as the State had not objected to such disposal. The respondents retained the right to seek re-hearing by filing an application if they wished to challenge the order.
