Kamalakhya Dey Purkayastha and Ors vs Union of India and Ors

Bench: 2 — Ranjan Gogoi

In Brief

The Supreme Court dismissed petitions challenging the use of the term 'originally inhabitants of the State of Assam' in the National Register of Citizens (NRC) preparation rules. The petitioners feared this classification would create a superior class of citizens with different rights regarding education and employment. The Court held that citizenship under the Constitution and Citizenship Act is the sole criterion for NRC inclusion, and being an original inhabitant or not creates no differential entitlement or benefit. Accordingly, no judicial clarification of the term was necessary.
