In Brief
The appellant was arrested in a case involving alleged prize chits circulation offences and financial crimes. An incomplete charge sheet was filed before the prescribed period expired, prompting the appellant to seek bail under Section 167(2) Cr.P.C. The High Court granted bail but directed that the appellant could be re-arrested upon filing of the complete charge sheet. The Supreme Court held that filing of a charge sheet cannot itself be grounds for cancellation or re-arrest on bail granted under Section 167 Cr.P.C.; bail can only be cancelled on other grounds available to the prosecution under law. The Court set aside the High Court's re-arrest direction.
