Supreme Court of India 2017-02-01 dismissed

Kamrunnissa vs Union of India

Bench: 3 — 3

In Brief

A widow petitioned the Supreme Court for compensation following her husband's death in a railway accident at Devanagere station in 2007. The Railway Claims Tribunal and High Court had rejected her claim, finding the deceased was not boarding a train but was crossing railway tracks when struck and killed. The Court upheld this rejection. Physical evidence—the body found on road (not platform), severed into two pieces, with no ticket—and the First Information Report clearly showed the deceased was crossing tracks while en route to Bangalore and did not notice the oncoming train. The petition was dismissed.
