Kamrunnissa vs Union of India

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A widow sought railway compensation after her husband died when struck by a train at Devanagere station in 2007. She claimed he was attempting to board with a ticket. The Railway Claims Tribunal and High Court rejected her claim, finding he was unlawfully crossing the railway track without a ticket and without notice of the oncoming train. The Supreme Court dismissed her petition, holding the investigative report and inquest clearly showed the deceased was coming from Bangalore direction, crossed the track inattentively, and was overrun. No ticket was found on his person, and the body's position confirmed he was not boarding the train. The claimant failed to prove entitlement to compensation.
