Karam Chand (Dead) By Lrs. and Anr vs State of Himachal Pradesh and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellants sought re-determination of compensation for acquired land at parity with amounts paid to others under the same acquisition notification under Section 28-A of the Land Acquisition Act, 1894. The Collector rejected their application citing delay. The Supreme Court held that while time limits exist, delay can be condoned in appropriate cases. The Court permitted re-determination of compensation, subject to denying interest for the delayed period. The impugned order was set aside and the matter remanded to the Collector for recalculation of compensation on this basis.
