Ramsingbhai (Ramsangbhai) Jerambhai vs State of Gujarat and Anr

Bench: 3 — Kurian

In Brief

The Supreme Court held that applications for re-determination of land compensation under Section 28A of the Land Acquisition Act, 1894, can only be filed based on the award of the original Reference Court, not based on subsequent appellate judgments under Section 54 of the Act. Section 28A explicitly refers to awards passed by courts defined as principal civil courts of original jurisdiction under Part III of the Act. Appellate courts operating under Part VIII fall outside this scope. The appellant sought relief based on the High Court's appellate judgment, which is not permissible. The appeal was dismissed."}
