Karma Dorjee & Ors vs Union of India and Ors

Bench: 3 — D.Y. Chandrachud

In Brief

North-eastern Indian citizens face widespread racial discrimination in employment, education, and daily life across the country. This writ petition sought guidelines to curb such discrimination. The Court held that Article 15's prohibition on discrimination, read together with the international Convention on the Elimination of All Forms of Racial Discrimination and the fundamental duty under Article 51A(e), requires comprehensive action beyond law enforcement. The Government must foster awareness of north-eastern culture, address discrimination in institutions and workplaces, and establish a monitoring committee under the Ministry of Home Affairs to oversee implementation of anti-discrimination measures and redress grievances, thereby translating commitment to racial equality into concrete reality."
