Katihar Medical College vs Union of India and Others

Bench: 3 — Ashok Bhushan

In Brief

Two private universities sought intervention in a medical college admission petition, claiming that an earlier Supreme Court order dated 9 May 2017 required states to conduct manual counselling for postgraduate medical courses. They argued that failure to implement this order resulted in vacant seats in their institutions. The Court rejected their applications, holding that the 9 May 2017 order applied only to undergraduate MBBS courses, not postgraduate courses. Consequently, the circular issued by the Ministry of Health and Welfare citing that order was inapplicable to postgraduate admissions. The Court reaffirmed that the 31 May 2017 deadline for postgraduate admissions could not be extended on this basis.
