Velayudhan vs National Insurance Co. Ltd. & Anr

Bench: 2 — M.R. Shah, Krishna Murari

In Brief

A motor vehicle accident victim with 100% permanent disability (a mason aged 40) sought enhanced compensation. The High Court had awarded Rs. 8,24,800. The Supreme Court held that the income assessment for calculating future economic loss was too low. It increased the monthly income base from Rs. 3,000 to Rs. 5,000, applied a multiplier of 15 years, and substantially increased compensation for pain and suffering from Rs. 50,000 to Rs. 4,00,000. The total compensation awarded was raised to Rs. 15,42,800 with 7.5% per annum interest from the date of claim petition."
