Kavitha Pavan Tibile vs Pavan H. Tibile

Bench: 2 — Kurian

In Brief

The appellant sought transfer of her divorce case from the Civil Judge's court in Hukkeri to the Family Court in Bangalore for convenience, but the High Court declined the request. The Supreme Court, exercising jurisdiction under Article 136 of the Constitution, allowed the appeal. The Court held that it is in the better interests of both parties to have the divorce proceedings tried at the Family Court in Bangalore rather than Hubbali. Accordingly, the Court set aside the High Court's order and transferred the case to Family Court, Bangalore.
