The appellant's father originally filed a suit to recover possession of Plot No. 27 in New Delhi from the respondents, claiming ownership. The respondent claimed title through a 1966 sale deed. After 36 years of litigation involving the trial court, first appeal, and High Court second appeal, all three courts dismissed the suit. The Supreme Court reversed, holding the appellant proved ownership through an uncontested chain of title from 1948. The respondent's sale deed was fabricated: the original record at the Sub-Registrar showed the buyer as 'Balwant Singh' not 'Baldev Singh' and omitted the plot number, while the property could not be carved from the plots Dharampal owned. The suit for possession was decreed in favour of the appellant.
