Kedar Nath Kohli sought to recover possession of Plot No. 27 in New Delhi from Baldev Singh. The respondent claimed ownership based on a 1966 sale deed from one Dharampal. The Court found the respondent's deed was forged: the original registered deed from the Sub-Registrar's office identified the purchaser as 'Balwant Singh', not 'Baldev Singh', and omitted the municipal number. Crucially, Plot No. 27 was never owned by Dharampal; it was owned by Kesara Devi and later sold to the appellant's father Mehar Chand in 1952. The Court decreed the suit, holding the appellant is the rightful owner and entitled to possession, and found the trial and appellate courts erred by failing to carefully examine the documentary evidence and site maps proving forgery.
