Keshav H. Gholve and anr. Etc vs Thermax Ltd. and Etc

Bench: 2 — Kurian

In Brief

Two workmen were denied legal representation in a domestic enquiry conducted by Thermax Ltd. The Supreme Court held that while lawyers cannot represent workmen unless management also engages counsel, workmen retain the fundamental right to representation by a company employee or trade union representative of their choice. The Court clarified that company standing orders cannot restrict this choice of representative, and the appeals were disposed of with directions securing the appellants' representational rights in the enquiry.
