Khilendra Singh vs Union of India Ministry of Agriculture through Secretary & Ors

Bench: 2 — L. Nageswara Rao

In Brief

The appellant, belonging to the Jaat caste, was appointed to an OBC-reserved central post in 2007 but his services were terminated when it was discovered that Jaat was not on the Central OBC List for Uttar Pradesh at that time. The newly formed State of Uttarakhand had been directed to follow Uttar Pradesh's OBC list for central posts until its own list was finalized. The Supreme Court upheld the termination, holding that since the appellant's caste was not in the applicable list at the time of selection, his appointment was invalid, regardless of Jaat's later inclusion in Uttarakhand's list in 2014.
