Khilendra Singh vs Union of India Ministry of Agriculture through Secretary & Ors

Bench: 2 — L. Nageswara Rao

In Brief

Khilendra Singh, belonging to the 'Jaat' caste, was appointed as a Subject Matter Specialist in a post reserved for Other Backward Classes (OBCs) in 2008, based on an OBC certificate issued by the Uttar Pradesh government. His services were terminated when it was found that 'Jaat' was not included in the Central List of OBCs for Uttar Pradesh at the time of selection. The Supreme Court dismissed his appeal, holding that the National Commission for Backward Classes' resolution directing use of the Uttar Pradesh Central List for Uttarakhand vacancies was binding, and since 'Jaat' was not in that list during selection in 2007, the termination was justified.
