The Supreme Court held that while execution petitions normally proceed independently, custody cases require the Court's parens patriae jurisdiction focused on the child's welfare. Although the father's consent decree awarded him weekend visitation, the child consistently objected to these visits. The Court did not wholly deny the father contact but granted limited Sunday visitation (4–6 PM) with a caretaker present, pending the Family Court's decision on both the execution petition and the mother's modification petition within three months.
