Supreme Court of India 2020-11-16 dismissed

Kirpa Ram (deceased) through Legal Representatives & Ors vs Surendra Deo Gaur & Ors

Bench: 3 — <UNKNOWN>

In Brief

Kirpa Ram and others appealed a High Court judgment dismissing their suit for injunction and declaration relating to land possession. The Supreme Court upheld the dismissal, holding that the Civil Court has jurisdiction to decide disputes over land possession and boundary issues, as the Land Revenue Act contains no express or implied bar to such jurisdiction. The Court found that since only the Civil Court can grant injunctions on possession matters (no such mechanism exists under the Land Revenue Act), the lower courts properly entertained the suit. The Court also clarified that the High Court need not frame substantial questions of law when affirming findings of the First Appellate Court if no errors are identified.
