KIRPA RAM (DECEASED) THROUGH LEGAL REPRESENTATIVES & ORS vs SURENDRA DEO GAUR & ORS

Bench: 3 — L. Nageswara Rao, Hemant Gupta, Ajay Rastogi

In Brief

A property owner challenged a High Court judgment dismissing his second appeal in a suit for permanent injunction over disputed land in Delhi. The owner argued the High Court failed to formulate substantial questions of law as required under Section 100 of the Code of Civil Procedure. The Supreme Court held that a High Court need not formulate such questions when it finds no error in the lower courts' findings. The Court also confirmed that civil courts retain full jurisdiction over possession-based injunction suits even if land involves Bhumidari status under Delhi land reforms legislation, as such statutes do not bar civil jurisdiction in such matters. The appeal was dismissed.
