In Brief
Krishan Kumar's eviction suit against Krishna Nath alleged material alteration of the rented premises through removal of a load-bearing beam. The Court held that the plaintiff failed to discharge his burden of proving structural alteration; the alleged removal of a critical supporting beam was implausible since the ceiling would have collapsed immediately. Rent inadequacy alone does not justify eviction. The Court accepted the defendant's offer to pay enhanced rent and allowed the appeal, while preserving the plaintiff's right to seek eviction on the independent ground of personal necessity by filing a fresh suit.
