Rajender Bansal & Ors vs Bhuru (D) Thr. Lrs. & Ors

Bench: 2 — A.K. Sikri

In Brief

The Supreme Court held that when an eviction suit is validly filed in civil court before rent legislation applies to an area, the civil court retains jurisdiction to decide the suit even after the area becomes notified under rent control laws—provided the rent act does not expressly bar civil court jurisdiction for pending cases or protect ex-tenants. The landlord-appellant had sought eviction for non-payment of rent (14 years) and unauthorized subletting before notification. Though the area was notified mid-suit, the Court ruled that rights crystallize at filing and the trial court decree should stand executable, restoring the trial court's judgment.
