A teacher claimed appointment as Lecturer in Military Science and filed for salary payment. The High Court dismissed his writ petition, but later review showed the court had cited paragraphs from another teacher's companion petition (Dr. Triyogi Nath's case) instead of reviewing the correct pleadings. The Supreme Court held that a writ petition must be decided on its own pleadings and facts, and that a review application raising apparent errors cannot be rejected without explanation. The matter was remitted to the High Court for fresh decision on the merits of the actual case."
