KSB Ali vs State of Andhra Pradesh & Ors

Bench: 2 — A.K. Sikri

In Brief

This case involves competing claims to 1,635 acres of land in Kokapet village. The legal heirs of Nawab Nusrat Jung Bahadur-I (who purchased the land in 1852) claimed ownership based on a 1954 Atiyat Court order and subsequent government memos. The State of Andhra Pradesh asserted it became the owner under the Abolition of Jagirs Regulation. The Supreme Court dismissed the appeals, holding that title disputes—even involving the State—must be decided by courts, not the Executive. The Court also found that the petitioner Mr. K.S.B. Ali had abused the process by filing fresh writ petitions after abandoning earlier ones, and that none of the petitioners had established their legal standing as heirs."
