In Brief
This case involved competing claims to approximately 1,635 acres in Kokapet village. Nawab Nusrat Jung Bahadur-I purchased the land in 1852, and after his death without heirs, hundreds of people claiming descent sued the State of Andhra Pradesh. The Atiyat Court in 1954 recognized it as Madad-e-Maash (grant-in-aid) for the heirs, but the State later issued conflicting memos. The Supreme Court dismissed the appeals, holding: the government cannot adjudicate title disputes (a judicial function); government orders must follow constitutional procedures and be communicated to parties to create rights; the appellants lacked locus standi to litigate; and filing fresh writ petitions after withdrawing earlier ones constituted abuse of process. The lands belonged to the State under the Abolition of Jagirs Regulation.
