Multiple petitions challenged the tribunal appointment procedures under the 2017 Rules. The Court issued interim directions modifying the Search-cum-Selection Committee structure and appointment terms. On 22 February 2018, it addressed the status of 19 tribunals' selection processes. The Court held that tribunals where substantial selection steps had already occurred (CESTAT, DRT, DRAT, NCLAT, NCDRC members, AFT) should proceed unaffected. For tribunals with minimal progress, the interim directions would apply. The Court rejected suggestions for uniform 5-year terms and High Court judge conditions, instead maintaining existing statutory terms and service conditions."
