Multiple writ petitions challenged the constitutional validity of the 2017 Rules governing tribunal member appointments. The Supreme Court passed interim directions modifying the selection process: Chairperson appointments will be made by Chief Justice of India nomination (not through Search Committees); tribunal members will serve 5-year terms (not 3 years) with conditions equivalent to High Court judges; and all selections shall be protected from the final judgment outcome.
