L & T Finance Ltd vs Pramod Kumar Rana & Anr

Bench: 2 — M.R. Shah

In Brief

L&T Finance Ltd challenged orders from the National Consumer Disputes Redressal Commission directing its Director to personally appear and subsequently issuing bailable warrants against him for non-compliance. The complainant had alleged he was pressured into a settlement. The Supreme Court held that while the allegations were serious, bailable warrants should only be issued as a last resort. Since the company was represented through counsel and authorized representatives, and allegations were still unproven, issuing warrants was premature. The Court allowed the appeal and quashed the warrant orders, permitting continued representation through counsel while leaving room for the Commission to require personal appearance later if necessary.
