A real estate developer appealed against an order by the National Consumer Disputes Redressal Commission directing it to pay compensation for delayed delivery of a property. The developer argued it was exempt from paying compensation due to force majeure events that extended the delivery period. The Supreme Court held that while force majeure extends the contractual delivery deadline, it does not eliminate the developer's liability to pay compensation for delays falling within the agreed compensation framework. The developer remained liable to pay Rs 5 per sq ft for a six-month delay as specified in the agreement. The appeal was partly allowed.
