Five persons were convicted by trial court and the High Court for murder and attempted murder in connection with a violent assault in Mumbai on 10 December 2006 where one person died and another was injured. The appellants challenged their convictions, raising concerns about delayed disclosure of accused names and procedural issues. The Supreme Court held that while the prosecution proved guilt beyond reasonable doubt for three accused (Nos. 1, 5 and 6) based on eyewitness testimony, medical evidence and recovered weapons, the evidence against two accused (Nos. 2 and 3) was insufficient—resting solely on the injured witness's statement with no independent corroboration and no weapons recovered from them. The Court acquitted these two, allowing the appeals partly.
