Laxman Prasad Pandey vs State of Uttar Pradesh & Anr

Bench: 2 — A.S. Bopanna

In Brief

Two groups clashed on 8 May 2020 in Uttar Pradesh over a land dispute and money recovery. The incident involved indiscriminate firing that resulted in one death. Two FIRs arose—one from each group. In the first group's FIR, the High Court granted bail to three accused; in the second group's FIR, it rejected anticipatory bail to six accused. The Supreme Court held that bail orders must contain reasoned, specific justifications, not sweeping generalizations. Given the grave charges (murder, attempted murder, Arms Act violations), criminal history, unclear aggressor roles, and ongoing investigations, bail was unjustified. The Court set aside bail in the first FIR and dismissed anticipatory bail pleas in the second, but permitted the second group to surrender and seek regular bail on merits."
