Life Insurance Corporation of India vs Mukesh Poonamchand Shah

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Life Insurance Corporation of India challenged a Division Bench order that had restrained it from taking final action on a show cause notice to the respondent employee following his criminal conviction. The Supreme Court held that when an employee is convicted on criminal charges, the employer need not follow the full departmental inquiry procedure before imposing major penalties. The employer was acting within jurisdiction in issuing the notice to show cause after the criminal conviction. The Division Bench's restraint had no valid legal basis and was reversed, allowing the appeal.
