Lieutenant General Manomoy Ganguly challenged the appointment of Air Marshal Rajvir Singh as Director General Medical Services (Army), following earlier litigation where Ganguly had secured promotion to the Lieutenant General rank. The Court found that the appointment violated policy guidelines requiring that lateral transfers between services occur only in exceptional circumstances (none were identified). The Court also held that the methodology of assessing suitability through Overall Average Performance across officers' entire service records was foreign to the established criteria and not supported by the Court's earlier judgment. As the senior-most eligible officer who remained competent for the post, Ganguly was entitled to appointment. The Court set aside Air Marshal Singh's appointment and mandated Ganguly's appointment as DGMS(Army).
