A Major General in the Army Medical Corps was not empanelled for promotion to Lieutenant General by a Special Promotion Board in 2016. After a statutory complaint resulted in expungement of adverse remarks in his Annual Confidential Report, he underwent a Review SPB in 2017, but was again denied promotion. The Armed Forces Tribunal quashed the Review SPB proceedings, finding it had wrongly awarded him lower board marks than another junior officer with lower quantified marks. The Supreme Court upheld the AFT's decision, holding that the Review SPB must apply the same criteria as the original SPB, and since board marks were previously awarded commensurate with quantified marks, the respondent was entitled to equal marks once his quantified profile improved. The appeal was dismissed.
