The Supreme Court considered multiple writ petitions challenging the constitutional validity of The Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Act, 2010. Rather than deciding the constitutional questions in the first instance, the Court determined that the High Court of Bombay was the appropriate forum to address these matters on their merits. Accordingly, the Supreme Court transferred all three cases to the High Court for disposition, finding that such transfer would cause no prejudice to the parties and would allow the Supreme Court to benefit from the High Court's reasoned findings if further review became necessary.
