A partnership firm challenged the constitutional validity of The Ancient Monuments And Archaeological Sites and Remains (Amendment and Validation) Act, 2010 through a writ petition filed under Article 32 of the Constitution. The Supreme Court, comprising Justices Abhay Manohar Sapre and Dinesh Maheshwari, remitted the writ petitions and a transferred case to the High Court of Bombay for disposal on merits. The Court held that no prejudice would arise from such remittal and that it was more appropriate for the High Court to decide constitutional issues in the first instance.
