The Supreme Court was seized with a constitutional reference regarding whether persons holding a light motor vehicle (LMV) driving licence can drive transport vehicles of LMV class with unladen weight not exceeding 7500 kg. A prior three-Judge Bench in Mukund Dewangan had held they could without separate endorsement. Rather than deciding the merits, the five-Judge Bench directed the Union Government to conduct a comprehensive reevaluation of the matter within two months, considering road safety, livelihoods, and sector evolution. The proceedings were adjourned pending the Government's policy view, expressly clarifying the Court had expressed no opinion on the correctness of Mukund Dewangan.
