M/s. Creative Garments Ltd vs Kashiram Verma

Bench: 2 — Abhay S. Oka, Rajesh Bindal

In Brief

M/s. Creative Garments Ltd sought to challenge a Labour Court award directing the reinstatement of an employee (Kashiram Verma) with back-wages and continuity of service from December 1997. The employer claimed the employee failed to report for duty despite repeated communications and had not defended the Supreme Court appeal. The Court held that the award should be set aside because the employee abandoned his interest in employment by failing to report despite explicitly committing through his counsel to do so. The judgment also addressed broader procedural concerns, holding that permanent residential addresses of workmen must be furnished in all labour law applications; relying solely on union or representative addresses is insufficient for effective service and relief.
