M/S SUVARNA COOPERATIVE BANK LTD vs STATE OF KARNATAKA AND ANR

Bench: 2 — M.R. Shah, B.V. Nagarathna

In Brief

A bank filed a private complaint against accused persons for offences including cheating, criminal breach of trust, and conspiracy. The High Court quashed proceedings against one accused on the ground that other alleged co-conspirators were not charge-sheeted. The Supreme Court reversed this decision, holding that the absence of co-accused cannot be a valid reason to quash proceedings against a charge-sheeted accused. Each accused must face trial on the merits of the charges against them, and additional accused can be arraigned during trial if necessary under Section 319 CrPC.
