In Brief
An insurance company challenged an order of the National Consumer Disputes Redressal Commission (NCDRC) in a Special Leave Petition under Article 136 of the Constitution. The NCDRC had upheld the State Commission's decision ordering the insurer and a bank to pay the complainant for stolen goods and compensation. The Supreme Court held that no appeal lies to it against NCDRC orders in appellate/revisional jurisdiction under the Consumer Protection Acts. Instead, the petitioner must first approach the High Court under Article 226 or 227. The Court emphasized that Article 136 is for exceptional circumstances only and should not short-circuit available remedies. It disposed of the petition with liberty for the petitioner to challenge the order before the High Court.
