The appellant, a Lower Division Clerk, was promoted to Junior Stenographer on an ad hoc basis after successfully passing a departmental examination in accordance with recruitment rules. She later sought regularization from the date of her ad hoc appointment. The tribunal allowed her application. Respondent No. 4, another LDC, challenged this through writ petitions, arguing she was a necessary party. The High Court set aside the tribunal's decision on this ground. The Supreme Court held that Respondent No. 4 was not a necessary party since she had chosen not to appear in the selection test, and the appellant's relief was independent of any claim by Respondent No. 4. The Court allowed the appeal and restored the tribunal's decision.
