Madan Mohan Bhakat vs State of West Bengal & Ors

Bench: 1 — Madan B. Lokur

In Brief

Five brothers (Marjit family) jointly owned agricultural land in West Bengal that was being used as a cattle market. An administrative notice issued under the Land Reforms Act was received by one brother, Chinmoy Marjit, who replied on their behalf. When the land was ordered for auction sale due to misuse, the brothers challenged the auction, arguing the notice should have been served on each of them individually. The Supreme Court held that service on one co-owner residing with others under the same roof was sufficient notice, and that neither the Act nor its Rules required individual service. The Court upheld the auction and set aside the High Court's order quashing it.
