Madan Mohan Bhakat vs State of West Bengal & Ors

Bench: 2 — Madan B. Lokur

In Brief

The Supreme Court held that a statutory notice issued under West Bengal Land Reforms Act, 1955, Section 4(4), requiring agricultural land to be used only for agriculture, need not be served individually on each co-owning brother when they reside together as a family. Here, notice served on Chinmoy Marjit in March 1975 regarding land misused as a cattle market was effective for all five brothers. The Court found their relations cordial, they lived under one roof, and the recipient's reply was implicitly accepted by all. The High Court's reversal was set aside, and the auction sale upheld."
