In Brief
This case concerned a partition suit filed by a man claiming an 8/20 share in ancestral property through his mother Chiruthey. The Supreme Court held that Chiruthey, who remarried after the death of her first husband Madhavan, lost all rights to Madhavan's property under Section 2 of the Hindu Widow's Remarriage Act, 1856. Although lease deeds executed in 1910 were valid insofar as they involved other legal heirs, Chiruthey's own entitlement had expired upon her remarriage. Therefore, her son from the second marriage could not inherit through her. The Court dismissed the partition claim, holding that the lease was limited to twelve years and provided no path to ownership for the plaintiff.
