Madhavi, a teacher holding B.A. and B.Ed. degrees, was appointed to a secondary school on 16 July 1985 in Category C. Chagan, with only Senior Secondary Certificate and Diploma in Education, was appointed on 1 August 1985 in Category E, later acquiring a B.Sc. (1997) and B.Ed. (1999) to move to Category C. When Madhavi was promoted as Head Master in 2014, Chagan challenged the promotion, claiming seniority from his initial appointment date. The Court held that seniority in secondary schools (Schedule F, Clause 2) depends on the category of qualification at appointment, not the date of joining. Since Chagan lacked the requisite trained graduate qualification at appointment, he cannot claim Category C seniority from 1985. Madhavi's appointment was valid and her promotion upheld. The Court distinguished the primary school rule (Clause 1) from the secondary school rule (Clause 2).
