Madhu Rani was granted anticipatory bail on condition of depositing Rs. 1,50,000 in an FDR for three years or until disposal of the case. She and other accused were later discharged. The Court held that upon discharge, the appellant became entitled to encash the FDR, as the condition to maintain it unencashed applied only during the criminal proceedings. The appeal was allowed, permitting the appellant to recover the deposited amount.
